Most countries issue multiple types of visas, but one lesser known document that is substantively important is the stapled visa. Understanding What a Stapled Visa Means
A stapled visa is a type of travel document where the visa of the travel document is not stamped or taped directly onto the passport, but instead is attached to the passport by staples or a separate piece of paper. When the visa is not stamped or placed directly in the passport pages, it is not officially integrated into the passport pages. This is not normal since most countries will stamp/print the visas in the passport pages directly, and stapling gives it a certain uniqueness which carries dire political and diplomatic measures. The country issuing the stapled visa is indicating they do not reasonably recognize the passport as valid nor do they recognize the territory's sovereignty by the issuing state over the travel's region of origin.
In other words, not only is the stapled visa as a travel insurance document, it is actually used as a symbolic political measure.
Why Are Stapled Visas Granted?
First, let’s start with an understanding of what a stapled visa is by looking at the context behind them. Stapled visas are typically issued because of a territorial dispute or region claimed by two different states and/or countries. In a sense, when a state grants a stapled visa, it communicates a political position that questions another state's control or sovereignty over the territory.
Key Reasons Stapled Visas Are Granted:
Political Position: In other words, the issuing state disagrees on the title or status of a particular territory.
Symbolic Non-Recognition: It also does not stamp the passport, as it would indicate it recognizes the disputed area as subject to that passport's issuing nation.
Diplomatic Signaling: A stapled visa serves as a signal from a state of disapproval in a diplomatic tone rather than a basic administrative decision.
Example: The India-China Stapled Visa Controversy
Among the most frequently discussed stapled visa examples is that between India and China. As we know, China has issued stapled visas to Indian citizens from Arunachal Pradesh (and sometimes Jammu & Kashmir) on numerous occasions.
What happens in this case is that the Chinese government issues Indian citizens from those regions a Chinese visa on a separate piece of paper rather than stamping it directly into their passport. Then, the Chinese visa is stapled to the passport.
This is done because China claims that Arunachal Pradesh is part of its territory (“South Tibet”) and, therefore, does not recognize Indian sovereignty over the region.
This is unacceptable to the Indian government because it implies that the government of China does not recognize Arunachal Pradesh or Jammu & Kashmir as part of India. Consequently, the Indian government has refused to acknowledge the stapled visa as a travel document and denies the right to exit the country based on it.
As we can see, the stapled visa matter is about more than just travel; it is a matter of national identity and sovereignty.
Effects on Travelers
For travelers, a stapled visa can cause issues. Here’s the reason why:
Non-acceptance: The immigration officers in the home country may not deem the stapled visa valid travel documents.
Refusal of Travel: Airlines or border control may not want to let a traveler board due to the visa not being stamped in the passport.
Diplomatic restrictions: If your country has raised objections to stapled visas you may not be allowed to travel on a stapled visa.
This is the case for Indian travelers. Now, no matter how well-traveled you may believe you are, the MOFA (Ministry of External Affairs) has issued a clear directive, which is: If you are an Indian citizen and you are issued a stapled visa from China, do not travel with it.
The Diplomatic Value of Stapled Visas
Stapled visas are not prevalent internationally and are usually only used when there is some political disagreement. However, they are important to the traveler and their intended length of stay, or multiple entry, or if the destination is held in an unsettled border area.
For the countries involved, the stapled visa can be seen as a form of protest, or submission, as it challenged the territorial status quo in the global geopolitical arena, signifying that boundary issues remain unsettled.
In diplomacies, a small matter such as where a visa is affixed carries a lot of potential for meaning. This is why it is important for a traveler interested in international relations, or border state travel, to understand the significance of receiving a stapled visa.
India's Position on Stapled Visas
India has stood firmly in opposing stapled visas issued by China and continues to view them as an infringement on its sovereignty. The Indian government emphasizes that Arunachal Pradesh and Jammu & Kashmir are an integral part of India and any attempt to contest this practice through issuance of visas is unacceptable.
Indian officials have repeatedly raised this point during taxpayer diplomacy with China and encouraged them to stop issuing these types of visas. However, every time this issue has come up in discussions the issue of stapled visas becomes a point of contention since India is loath to give it tacit approval during budding conversations about contested border areas.
When India refuses to recognize stapled visas it sends a clear message that India is not going to concede to any inferences to national sovereignty.
