What is Workmen Compensation Policy

Share

A serious workplace injury can have a profound impact on an employee, affecting not only their ability to earn a livelihood but also the welfare of their family. For employers, such incidents carry the responsibility—both moral and legal—of providing support during these challenging times.

According to the Workmen’s Compensation Act of 1923, if your business involves physical labour or operational tasks and is not covered under the Employees’ State Insurance (ESI) Act, you are legally obliged to compensate affected employees. This financial compensation applies in the event of a work-related injury, illness, or fatality.

What is Workers’ Compensation?

Workers’ compensation refers to financial support provided to employees who are unable to work due to an injury or illness sustained in the workplace. It is designed to help cover everyday living expenses by replacing a portion of their lost income.

The amount of compensation depends on the severity of the injury or disability. This policy is also applicable to contract or temporary workers.

The workmanship compensation policy provides cover in cases of:

  •  Death
  •  Permanent total disability
  •  Permanent partial disability
  •  Temporary disability

If an employee is unable to work for a period of time due to a work-related injury, the Workmen Compensation policy ensures they continue to receive a portion of their regular wages while they recover.

Beyond income support, a WC policy may also include cover for medical expenses, such as treatment costs and rehabilitation therapies. Additional medical cover or medical extension cover can be added to extend this benefit further.

This ensures that employees are not financially burdened by healthcare expenses resulting from workplace accidents. The scope of cover and benefits available are outlined in accordance with the Workmen’s Compensation Act (WC Act).

What is the Workmen’s Compensation Act?

The Workmen’s Compensation Act of 1923 sets out the rules and provisions for offering financial protection to workers injured due to workplace accidents. Following the 2010 amendment, the Act was renamed the Employees’ Compensation Act, 1923, to reflect a more inclusive approach.

The Act mandates that employers must compensate workers in the event of injury, illness, or death arising out of and during the course of employment. Employees not covered under the Employees’ State Insurance (ESI) Act are eligible for protection under this Act.

Here are the key provisions of this act:

  • Employer’s Liability: Employers are legally obligated to compensate employees for loss of income resulting from disability or death caused by work-related incidents.
  • Eligible Employees: The Act outlines the sectors and employee categories eligible for compensation, such as construction workers, drivers, and ship crew members.
  • Compensation Amount: The Act provides detailed methods for calculating compensation amounts depending on the type and extent of disability or fatality.
  • Exemptions: Certain exclusions apply, such as when the employee is under the influence of alcohol or drugs, or has disregarded safety regulations.

For comprehensive information and the latest updates, please refer to the Workmen’s Compensation Act of 1923.

What Does Workmen's Compensation Insurance Cover?

When you take out Workmen Compensation policy, both you and your employees are protected in the event of the following:

Accidental Injury

If an employee sustains a bodily injury as a result of an accident that occurs in the course of their employment, the policy provides appropriate cover.

Occupational Illness and Disease

Certain workplaces may expose employees to harmful substances such as chemicals or allergens, which can lead to illness. This insurance helps cover the cost of medical treatment if an employee falls ill due to such exposure.

Disability Cover

Injuries sustained at work may sometimes result in temporary or permanent disabilities (such as loss of vision or limbs). This policy can help pay for medical expenses and offer compensation for a portion of the employee’s lost earnings.

Death Benefits

In the unfortunate event that an employee loses their life due to a work-related incident, the insurance covers funeral expenses and provides death benefits to their dependants.

Medical Coverage

Medical treatment can be costly. This insurance helps cover the medical expenses incurred in treating injuries sustained in the course of employment.

Why You Need a Workmen Compensation Policy?

Whether you're a small business owner or manage a large workforce, having a Workmen Compensation Policy is essential, not just for legal compliance, but also for protecting your employees and your business.

Legal Obligation

Under the Employees’ Compensation Act, 1923, employers are legally required to compensate employees for injuries, illnesses, or fatalities arising out of their employment—especially those not covered under the Employees’ State Insurance (ESI) scheme. Without this policy, any compensation must come directly from the company’s funds, potentially leading to financial strain or legal action.

Employee Welfare & Retention

Providing a compensation policy builds trust, improves morale, and shows that you value your employees’ safety and security. This can enhance loyalty and retention, particularly in high-risk sectors like manufacturing, construction, or logistics.

Financial Protection for Employers

The policy covers medical bills, wage replacement, and other costs related to workplace incidents. It shields the business from sudden, large out-of-pocket expenses and reputational risk.

Customisable Coverage

Many insurers offer flexible plans that can include medical extensions, rehabilitation support, and even wellness add-ons—providing well-rounded protection for your workforce.

What is Not Covered Under Workmen’s Compensation Insurance?

Here are some of the exclusions under Workmen’s Compensation Insurance:

War-Related Injuries

Any injury—whether by accident or disease—resulting from war, invasion, acts of foreign enemies, hostilities (whether war is declared or not), civil war, mutiny, insurrection, rebellion, revolution, or military or usurped power is excluded from cover.

Contractor’s Employees

The policy does not cover the employer’s liability for workers who are employed by third-party contractors.

Non-Workmen

Employees who do not meet the definition of ‘workman’ as set out under the Employees’ Compensation Act, 1923, are not covered by this insurance.

Contractual Liabilities

Any liability assumed by the insured under an agreement, which would not otherwise exist in the absence of such agreement, is excluded from cover.

Private Agreements Between Parties

Any amount that the insured would have been entitled to receive under a separate agreement with another party is not covered.

Recent Updates to the Workmen’s Compensation Act

Since its introduction in 1923, the Act has undergone significant revisions to enhance employee protection. Two major updates are as follows:

Name Change in 2010

In 2010, the Act was renamed from the Workmen’s Compensation Act to the Employees’ Compensation Act, reflecting a broader and more contemporary definition of the workforce.

Increase in Compensation Amount in 2020

On 3rd January 2020, the Ministry of Labour and Employment raised the wage threshold used to calculate compensation from ₹8,000 to ₹15,000. This nearly doubling of the base amount ensures improved financial assistance for employees and their families in the event of workplace-related injuries or fatalities.

Wrapping Up

Workplace injuries can severely affect an employee’s life and their family’s financial stability. Employers have a legal and ethical duty to support affected workers. The Employees’ Compensation Act, 1923 ensures compensation for job-related injuries, illnesses, or death—especially for those outside the ESI scheme.

Workmen’s Compensation Insurance helps fulfil this responsibility by covering accidental injuries, occupational diseases, disabilities, and fatalities. It also includes medical and rehabilitation expenses, easing the financial burden during recovery. However, exclusions apply—such as war-related injuries and contractor-employed workers.
